Theory: 360 manufactured in 2005 are ban-safe!
reason to believe this theory: On IRC I met 3 people (including me) who constantly play on live with random burned games. They all have a MS-25 drive and a 360 manufactured in 2005. But they all have different fws. For example I have a extreme 1.3, the next one had a 5.2 and the next one another one. We are only using scene releases, where some are stealthed and some arent. All three consoles are not banned!
In early 2006, rumors were everywhere that a firmware hack is coming. Maybe, just maybe, Microsoft reacted to this rumor very fast and implemented something on the hardware or eeprom to verify certain modifications.
Now please, only respond to this thread if you have a 2005 manufactured console and tell if its banned or not.

m$ did respond by changing hardware, the ms28. it included a flash protection system that was easily passed (vcc trick).
i dont think that it has to do with the dates of manufacture, more to do with the games and stealth/frequency of playing online.
as c4eva has stated banning is a manual process, if you are on live online with backups all the time you'll most likely get banned. people with firmguarded fw have been banned, and people with 1.3 Fw still are on. the only way i can see the last example happening is coz they havent done enough to get themselves noticed.

My console is 2005 with MS25. Flashed once with xtreme 3.3.. Only stealth disks played. Banned.

2005 machine
fw history: every revision since first release now 5.3c
currently unbanned and playing online with backups (no multiplayer yet, i will attempt a few games tonight and post the results)

just put in a game with invalid / missing PFI and/or DMI and play on live with it... do this for the testing scene

to play safe....just buy the original game for high demanded multiplayer game....example....GOW..forza...GRAW...R6...HALO...yup just play safe...and play backup game for sp...and also...dont connect to live while u playin backup ...otherwise u'll be trapped and logged by M$...wut else can we said....just play safe dude...not all games are best in MP...only few...and some of them were good in SP but not in MP....anyway i think its all ur choice...PEACE n OUT

one launch console here banned one 2006 ht46/2.3 banned one ms28/5.2 aLive -no stealth multiplayer games everyday ......

Ok some extra info:
Just rebooted the Xbox. It displayed a normal log, no DMI/PFI requests whatsoever. Once i logged in to Xbox live, it immediately requested the capacity, did a drive inquiry, and read the DMI/PFI !!

it seems stealth is the key as m$ is checking the discs and not the firmware.

I to have several 360's still on XBlive flashed with 5.3c and the backups I have been using are all stealthed media made with XBC. I have been paling crackdown along with the halo3 Beta release. I flashed all my drives using the 360 as the power source as well this may be to my demize later, will just have to see.

i'm in the same boat as you mech engineer (same job as well lol)
never liked using the tx kit as i killed 2 hitachis sparkin the pc power connector whilst inserting it.
i hope that the 360 does not log when the thing boots with no sata. surely this would not be a good idea for m$ say a console had a faulty sata cable (ive had a few flashing them!!) not only would the 360 need repaired, but as soon as the kid gets it back he gets a nice ban hammer strike from wankpot bill.

they might log it.. but this is no proof of having a modified console... this whole theory its crazy.. people belief in whatever those hackers are saying, as if they are gods..lol its quite funny
i had that error once as if my dvd drive wasn't connected, worth a ban? people in repair centres swap drives, they might disconnect the cable, ban worthy? i doubt it

I'm guessing i'm lucky at the moment, i never stopped playing on live while all the bannings were happening as it doesnt really fuss me if i get banned or not.

Launch console here, MS-25 was banned back in May. The SS and PFI for a couple of my backups were not correct and I believe that is how they got me.
