Thanks for asking. This was my point. At this time it doesnt matter because you might have already been logged for playing backups with non stealth.

This was my point they checked for backups a while back so if you didnt use stealth firmware you got screwed and guys who have only used stealh on sammy's are all fine

my xbox360 :

17 may : STATUS : unbanned
-> ms25 5.2c first bios flash before connecting to xbox live (used old live account)
-> console is from 18/10/2005), but only in use since 27/01/2007) PAL
-> upgraded to 5.3c
-> spring update-> everything works (update on : 13 may 2007)
-> didn't play any backup online
-> only played backups of spiderman 3 pal stealth(internet release), virtua tennis 3 pal(internet release), c&c3 pal(internet release)
18 may : STATUS : unbanned
-> did HD-DVD update
-> didn't play any games, only mov trailers
19 may : STATUS : unbanned
-> played Van helsing HD-DVD
20 may : STATUS : BANNED ....

i flashed my mates samsung ms25 i believe around last august i woud have used the very latest version of the flash program to do it so whatever release was out back then hopefully you can figure that out.

status not banned and still using backups aswell as originals.
i flashed the 360 streight out of the box it had never been used before i flashed it using the power from the 360 with the video cable plugged in i have never updated to a newer FW its been flashed once on that first day out of the box he is on live right now.

wish i could tell you more about weather it is a ms25 or 28 im 90% sure its a 25 though and also i wish i could tell you exactly what version of the flash program i used at the time it was between august and september last year and when ever i want to flash a drive for someone i sign in to efnet channel #FW and ask what the latest safest version of the flasher is for the drive im about to do.

so if i used stealth fw and stealth backups and after the update i downgraded my fw to original fw, shud i be not worried to get banned? if you theory is valid i mean.

one more thing: if i have original fw but insert a backup, can that be a problem, althought obviously it wont be recognized.

Bull$#!t man... all your theory is not confirmed... i have 3 friends with hitachis, with OLD no Disk Jitter, and all of the 3 are NOT BANNED and continue playing games in live...
I have 2 friends with ms25 and ms28 sammys and the same!!! all are playing backups and using old 3.0 and 3.1 extreme FWs...
But the 5 ppl repeats on a single pattern... and at this time is the only pattern that repeats... the 5 friends... BOUGHT the 360 and when received it THEY NEVER NEVER TURNED IT ON and CREATED THE FIRST PROFILE BEFORE FLASH THE DRIVE!!!
So the 5 guys bought the 360... OPEN IT, EXTRACT THE DRIVE... some power on it trough 360 and some through external power supply, then FLASHED IT... and then they TURNED THE 360 ON FOR FIRST TIME, and CREATED the INITIAL PROFILE with the DRIVE ALREADY FLASHED... no one of the 5 NEVER TURNED the 360 ON BEFORE FLASH to PLAY WITH THE ORIGINAL FW!!! So thats the pattern i see!

Other ppl that flashed after the first BOOT UP! can be banned or not, no pattern see there.

Well im sad to confirm that my theory is DOWN/DEAD!!!
today my 9 NOT BANNED friends!!! was all BANNED FINNALLY!!!

And i can add to the list 2 friends more that are banned flashing his 360s before ever turned it on and using only STEALTH PATCHES in Samsung ms25 and ms28 and both updated to Jitter versions Before the Spring Update... (BOTH WAS BANNED THIS EVENNING TOO)

Perhaps enough data to verify the game is a backup can only be collected after a certain amount of play time?

That is pretty interesting...assuming that person is trustworthy (I like to give the benefit of the doubt).  If the drive speed is the dead giveaway, then which version of the Samsung firmware should people be flashing?

sorry but my 1 modder friend said he got a ton of calls from customers with hitatchis with latest stealth firmware set to read same speed as originals and they are banned and like 15 of em were new plastic seal intact in the cardboard box never  even turned on

I think you are missing the point.  Backups read slower because of the media quality.  A pressed disk reads faster. According to that guy, they do a diagnostics on the read speed and if its burnt media it will read slower and ban hammer will fall.  This makes me wonder if you crank the read speed to 12x and if this is the common denominator for people who arn't banned?

Couple of questions
1. Do you play both backups and originals?
2. Does yours play both backups and originals at the same speed
3. Did you use any of the firmwares that change the speed based on backup or original detection

Now they can check samsung stealths with disc jitter check but not if you updated to 5.3 before the dash update.

B.S! I updated mine to 5.3 before the update, yet I was still banned.

You guys dont read, that was my exact point.

It didnt matter if you updated befoe the dash update if you have used any form of non stealth on xbox live you have been recorded a long time ago and were added to ban list.

hust cause u update now doesnt mean $#!t even if you invert to original FW wont matter you already got recorded a long time ago.

Maybe the 360 knows when the SATA cable is unplugged from the drive when people flash them when they take the power from the 360 itself and not one of those connectivity kits or something, so it logs it somewhere and sends the info back to MS?

I absolutly would not flash back to the original.  Most of the theories to date say that consistancy is the most important.
