To the post above.... no, that is stupid logic, if you banned then its game over. Just take the disc out turn it on log into live and take a look. So far from what I've seen a disc has to be in the drive to ban.

 the 46 had 2.3v firmware that was installed in april. and the spring update , played crackdown with original disk , never played halo : banned

i also have a 47d which i installed the new 2.4 frimware on BEFORE i installed the spring update,  this one never played crackdown or halo at all : Banned

Updated in April before spring update, did not use any backup since update.  Did play original GRAW.

I WAS BANNED WITH NO DISK IN THE DRIVE!!!.  I booted up and was not able to get in.  
The laste games I played were robitron and Aegis.  

Maybe M$ already had the data from previous dash update and is diabling alphabetically.  My last name starts win an A.

I never played crackdown or Halo 3 beta, I live in US.  One other note, I did not get the text saying I was banned, only yhe error code.

More likely than your gamertag name, i'm sure everyone has an xbox live 'number' that you can't see that is received upon registration of your gold membership.

so you didn't have 2.4 then as that was released after the spring update?, also didn't one of the two flash programs have the steath part removed (toolbox3.1) due to the 2.4 firmware, where as garyopa's had it still implemented in the flash, could be why some hitachl's if updated before the spring upgrade (if they waited) and used the righ flash program (i would think the one with stealth firmware -garyopa's) then they are fine?

A friend of mine flashed mine and I don't know what kind of firmware I have or HD. It was done around December 2006 though. I dunno.

Well. I do know this. Still, trying to keep the speculation low in this thread, but I used the Stealthed, non maximus toolbox firmware. And i updated the firmware hours before updating my console. I had my xbox off for like a week and a half cuz I got a Wii. In any case, All of these details are important. I guess we could just ask MS what they did...

Ive played crackdown for about 10 min but never halo3.

I waited to buy a 360 until I knew I could play online with backup'd games. I guess I convinced myself M$ would never bust out the ban stick, afterall i still pay 8$ a month plus ive spent over 100$ in the marketplace.
Funny thing is I have only played 2 games online that are backups, gow and graw2, but i play them almost daily. I would be totally willing to go out and buy these two games and any future online games if i knew my console was not going to get banned.

For everyone with the banstick in your face just go to wallmart buy a new 360, swap the case and return your banned hardware in the new 360's case, they scan the serial on the sticker when you buy it... (pay cash )

Whats gonna suck about this is all the people who think they are getting a sweet deal on craiglist or ebay for a 360 only to find out its banned, those people are gonna get screwed for nothing they did.

I have a very old 360 with Samsung MS25 Drive. Originally Modified with Xtreme2.0 FW, and upgraded through v4.3 until the spring update. I upgraded to v5.3 before the update was installed and I can currently connect to Live. I have been playing Halo 3 Beta with an original Crackdown game. I have not played any games since I've heard of the banning, but figured I could help out by finding out the status of my Live account. I do not know if any non-original games were used on my system since the Spring update (Since I'm not the only one who uses the system), but as far as I know only Crackdown (Halo 3 Beta) and Guitar Hero II original disks have been used since the spring update.

Summary:
Samsung MS25
Updated from Xtreme 4.3 to 5.3c before Spring Update was installed
Used Latest X360SAM.exe to inject drive key to new firmware (Is there a difference between this and the batch files included with 5.3 i.e. spoofing?)
Only original games have been played since update
Can currently connect to XBL
Have not played any games since I heard of the banning (rumors?) this afternoon.

My guess is that they have recorded firmware information during first boot after the spring update, and if that has changed, flagged your 360. Sure there are some oddballs, but this seems fairly consistent...

Good luck to C4E, GaryOPA, any who ever else wishes to try to resolve these "Issues". 

My condolences to everyone out there who has been banned, but I cannot shed a tear. You knew what you were doing, and that you can pay for your actions. So either buy a new console and fork out the cash for those games you love to play online, or crawl over to Sony or Nintendo with your tail between your legs. I sincerely hope I do not get banned, but intend to buy an elite if i do...

Good advice, but be careful people! There is a tamper evident seal that is broken. Just know that like everything else, there may be a consequence. And think of the unlucky person that buys your banned console from Walmart or Target.... I'd be pissed as hell. Who knows if MS is also logging the user accounts that are using the modified consoles?!?! That can be very traceable!

Since its been a long day and I am too lazy, I won't warn or ban any of the previous posters for discussing pirated games. But since its obvious that how you obtain the backup isn't relevant at the moment, any post past this point that contain talk about downloaded or scene release games will be removed. But don't hesitate to post information about your setup in general if you were banned or even if you haven't been banned yet.
