I took over a small game company that is a Microsoft XDK Licensee. I have an extra 360 XDK and 360 Test kit that I want to sell. If I sell on Ebay and specify that only Microsoft Licensees can purchase, should I be in the clear? Or is there a better way to sell these units. I'm strapped for cash as I can always get more once money comes in.

Hey the post means that *IF* Microsoft want to cause trouble for the seller of the item, they can. Not that they *will* pursue the seller. By announcing such a sale publicly you run into the risk of having to return the XDK to Microsoft.  Or being targeted by scammers pretending to be Microsoft.

Exactly what l_oliveira said.  You can be sure that Microsoft has people who keep an eye on ebay.  And whether the postin the link I gave comes to the conclusion that the letter in question was fake it is the overall point that matters...
And yes I did read it...smarta$$
