I'm trying not to get banned so I have some questions. I have my 360 unplugged from Xbox live since I flashed it.

1) Is it safe to play original games on Xbox Live without getting banned?

2) They can detect backed-up games when you play them, but when I have a back-up in the tray but I just browse the dashboard, will they be able to ban me?

1) currently yes.
2) yes, since the disc is checked regardless.
